A Plaintiff –v- Portstewart Golf Club.

The Plaintiff claimed £15,000 for personal injuries as a result of the negligence and breach of statutory duty of the Defendant Golf Club for it’s failure to inspect, maintain and repair a fairway. The Plaintiff alleged that he was caused to go over on his ankle due to a hole which he alleged had been caused by a rabbit.

The matter was prepared as a contest on the basis that the rabbit hole, if it existed, was a natural part of the playing terrain on a golf course and that the Defendant had not been negligent in failing to notice the rabbit hole and to have it filled in.

The case was listed as a contest before Judge Smyth QC at Coleraine Courthouse and just before the case was about to commence the Plaintiff indicated that he would withdraw the Civil Bill. Accordingly the Civil Bill was dismissed.
