At the Cutting Edge of Insurance Fraud

Building upon our strong track record of anticipating and reacting to the demands of the ever changing insurance market Campbell Fitzpatrick is the first solicitor firm in NI to develop a dedicated Fraud Department.  

Insurance fraud has been traditionally perceived as a “victimless” crime however insurance fraud is never victimless - it increases insurance premiums and in some cases puts lives at risk. We are therefore committed to fighting back against insurance fraud and our success to date has resulted in substantial savings for our major insurance clients.

Our expertise extends to all aspects of motor/liability fraud and 1st party or policyholder fraud.

A number of our solicitors hold dual practising certificates for the Northern Ireland and the Republic of Ireland which places us in the unique position of dealing with any cross-border issues that arise in fraudulent cases.  The border is therefore no impediment to the services that we can provide to our insurance clients.

Motor/Liability Fraud

While motor fraud has been the primary focus for the insurance industry it is clear that fraudsters are increasingly coming within the radar of employer and public liability claims.  Our team of experienced lawyers deal cases covering the spectrum of “fraud” from the individual exaggeration of a bona fide claim, including minor impact claims, to complex, multi-party manufactured or staged accidents.

 Every file of papers we receive is scrutinised by our solicitors for fraud indicators. We understand that specialist skills and a certain mindset are needed, to be able to distinguish between the genuine and the dishonest claimant. We therefore have a number of strategies in place to detect a fraudulent claim.   

Campbell Fitzpatrick employs the most up to date technological systems to counter fraud with our very own in house fraud database.  Further use is made of external databases and systems adopted by insurance companies themselves, such as CACHE and CUE, which members of our team can access in order to view individuals who we expect of having pursued fraudulent claims.  We also focus on the admissibility of fraud evidence so as to optimise the effect of our investigations on court proceedings.  All evidence of potentially fraudulent claims are dealt with in accordance with the Data Protection Act 1998.

1st Party Fraud

We are frequently instructed by our major insurance clients to deal with all types of first party motor, property and travel insurance fraud.  Our expanding expertise particularly in the area of property fraud extends to pre-litigation claims of arson, subsidence and staged theft.  Our lawyers are well equipped to assess the adequacy of evidence obtained to date and to recommend further lines of enquiry.

We recognise that the burden of proving fraud in these cases is particularly high and may be difficult to prove.  Therefore our specialised lawyers in insurance contract law will investigate all possible technical arguments to repudiate a suspicious claim – including policy defences of breaches of warranty or condition and pre-inception material non-disclosure/misrepresentation.
