There have been an increasing number of accidents in the workplace recently, which have resulted in deaths of employees. Current legislation states that it is too difficult to secure a conviction against a company in respect of corporate killing. As the law stands, before a company can be convicted of manslaughter a “directing mind” of that organisation must also be personally guilty of the offence.

Essentially the new law will ensure that it is easier for a prosecuting authority to secure a conviction against a company where its activities have caused death and result in that company being liable to an unlimited fine.

This law will affect companies supplying services, as well as employers and occupiers of land, including premises and building sites.
