Campbell Fitzpatrick Solicitors acted on behalf of a Plaintiff in association with a claim she advanced against various Defendants arising out of medical treatment she received in and around 2002. During the course of that year the Plaintiff underwent surgery to resect pelvic endometriosis. As a result of the surgery performed the Plaintiff suffered a severe deterioration in her health and required an emergency laparotomy in order to treat her. During the course of that operation it was discovered that the young lady had sustained a large perforation in her bowel which required further treatment. As a consequence of this injury the Plaintiff was required to undergo a defunctioning colostomy, which was maintained for approximately 7 months.
The Plaintiff lost weight during her recovery period. She also suffered significant upset, depression and anxiety. The Plaintiff underwent surgical closure of the colostomy. The Plaintiff suffered scarring as a consequence of the procedures.
It was alleged that as a consequence of the negligent care in this matter that the Plaintiff’s fertility had been adversely affected. The Plaintiff now requires IVF treatment in order to become pregnant and she was originally inhibited as a consequence of the presence of hydrosalpinges. The Plaintiff therefore sought damages in respect of her personal injuries and the cost of future treatment.
Patrick Mullarkey of this office acted on behalf of the Plaintiff in the prosecution of the case. Medical evidence was commissioned which supported the Plaintiff’s allegation that the care that she had received at the time of the original operation in 2002 was below the standard that she was entitled to expect. Accordingly proceedings were issued and served on behalf of the Plaintiff in 2006. The case was fully pleaded and ultimately came into the list for hearing in 2009. The case settled on the eve of trial in the above noted sum. Payment was made without admission of liability.
