The Plaintiff, who lives in Dungiven, alleged that on 7 December 1998, while travelling as a front seat passenger in his own car, which was driven by his father, the Defendant, the car went off the road.

The Plaintiff sustained a laceration to his forehead, with permanent scarring, a wedge compression fracture of L1 and loss of wages.

On investigation, it transpired that the accident occurred on a road near Drogheda, Co Louth at 2.30am. The accident was not reported to the Gardai until the following day, and the Guards did not attend the accident locus, and there was no Garda Report available.

The Plaintiff did not attend hospital until 10 hours after the accident. Further, it transpired that the Plaintiff was disqualified from driving in Northern Ireland at the time of the accident.

The Plaintiff alleged that he did not see anything on the road, but that he heard a loud bang and the car then went out of control and travelled towards the verge on the other side of the road, turned and went over on the body a couple of times.

The case came on for trial, in the High Court, before Mr Justice Higgins on 25 September 2001. On the morning of trial the Plaintiff withdrew his case and judgement was entered for the Defendant against the Plaintiff with no Order as to costs.
